These Terms & Conditions (“Terms”) govern your access to and use of the Property Fusion website, mobile platform, tools, and services (“Platform”).
By creating an account or using the Platform, you agree to these Terms. If you do not agree, please discontinue use immediately.
1. About Property Fusion
Property Fusion (Pty) Ltd (“Property Fusion”, “we”, “our”, “us”) provides digital property management tools that connect landlords, tenants, agents, investors, and service providers.
We are not an estate agency, property owner, or legal party to any rental agreement or transaction between users. Our role is to provide a digital platform only.
2. Eligibility
To use Property Fusion, you must:

Be at least 18 years old;

Provide accurate registration details;

Have the legal authority to list or manage properties.
We reserve the right to verify identities where necessary.
3. User Accounts
You are responsible for:

Maintaining the confidentiality of your login details;

Ensuring your information is accurate and up to date;

All activity performed under your account.
If you suspect unauthorised access, notify us immediately at support@propertyfusion.co.za.
4. Subscription & Billing
Some Platform features require a paid subscription.
4.1 Fees

Subscription fees are billed monthly in advance.

Prices are displayed before purchase and may be updated with notice.

Payments are processed by approved third-party gateways.
4.2 Non-Payment
Failure to pay will result in:

Loss of premium features;
-
Account suspension;
-
Permanent deletion of your data after 60 days (Section 8).
4.3 Cancellations
You may cancel anytime via your dashboard or email.
Cancellation stops future billing, not past payments.
Refer to our Refund & Cancellation Policy for detailed rules.
5. Platform Use Requirements
You agree not to:

Upload false, misleading, illegal, defamatory, or infringing content;

List properties you do not own or have authority for;

Misrepresent yourself or impersonate another person;

Use the Platform to harass, defraud, or threaten others;

Interfere with system security, performance, or integrity;
-
Attempt to access data or systems without authorisation.
Violations may result in immediate suspension or termination.
6. User-Generated Content
Users may upload property images, lease documents, personal information, reviews, and messages (“Content”).
By uploading Content, you confirm that:

You own it or have permission to use it;
-
It does not infringe any third-party rights;
-
Property Fusion may store, host, display, and process it solely to deliver platform services.
You retain ownership of your content.
Property Fusion may remove content that violates these Terms.
7. Data Protection & Privacy
Your use of Property Fusion is governed by our Privacy Policy, which explains:

What personal information we collect;

How we process, store, and protect it;
-
Your POPIA and GDPR rights;
-
How you may request access, deletion, or correction.
8. Data Retention & Account Deletion
We maintain user data as follows:

Active subscriptions: data is fully retained.

Cancelled or unpaid accounts: data is kept for 60 days.

After 60 days: all profile information, property data, messages, and documents are permanently deleted unless legally required for compliance.
Once deleted, data cannot be recovered.
9. Platform Availability & Security
We strive to ensure the Platform runs reliably, but we do not guarantee:

Uninterrupted access,

Error-free performance,
-
Continuous availability.
We implement strong security measures, but you acknowledge that no online service is immune to risks.
10. Third-Party Services
The Platform may integrate with trusted third-party tools (e.g., payment gateways, communication services).
We are not responsible for the availability or accuracy of third-party systems.
Users must also comply with third-party terms where applicable.
11. Limitation of Liability
To the maximum extent permitted by South African law:

Property Fusion is not liable for any losses arising from interactions between landlords, tenants, agents, or service providers, including disputes, missed payments, property condition, fraud, or misrepresentations.

The Platform is provided “as is” and “as available”.

We are not liable for indirect, special, or consequential damages.

Our maximum liability is limited to the total subscription fees you paid to Property Fusion in the 12 months prior to the claim.
12. User Disputes
All disputes between landlord, tenant, agent, or any other parties are independent of Property Fusion.
We may assist with communication but are not obligated to mediate or resolve disputes.
Legal or contractual issues must be handled directly by the parties involved.
13. Account Suspension & Termination
We may suspend or terminate your account if:

You breach these Terms;

You upload harmful or illegal content;
-
You misuse or attempt to exploit the platform;
-
You fail to pay your subscription.
Suspended accounts may be restored upon resolving the issue or within the 60-day grace period (Section 8).
14. Changes to the Terms
We may update these Terms to reflect:

Changes in law,
-
New functionality,
-
Improvements to the Platform.
Updates will be posted on our website with a revised “Last Updated” date.
Continued use after updates means you accept the new Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Any legal disputes with Property Fusion must be handled in South African courts.
